So, the Secretary of State of the State of Illinois refuses to certify Blago’s nomination of Burris and the secretary of the Senate refuses to accept the nomination documents because they have not been certfied by the Secretary of State. There is no basis in law for either action. We may not think Burris is the best choice or simply don’t want to accept any nomination by Blago. But that is not provided for in the law.
The Illinois Secretary of State should be removed or ordered by a court to certify the document and the secretary of the Senate should accept it in any event since the Secretary of State’s certification is only a ministerial act.
If the US Attorney has any evidence that Burris was or was not involved in the Senate auction, now is the time to put up.
